END USER LICENSE AGREEMENT
This End-User License Agreement (the "EULA") is offered by the company DRAGONSLASH, a French company with capital of 20,000 euros, identified under number 821 658 986 RCS Montpellier, whose registered office is at 73 Boulevard de Strasbourg 34000 Montpellier France (hereinafter "DRAGONSLASH"), publisher of the software application entitled "REIGN OF THE NINJA" (hereinafter the "Application").
The use of the Application is subject to full acceptance of the EULA defining the relationship between users (hereinafter "you") and DRAGONSLASH. Please read the EULA carefully. In the absence of such acceptance, you cannot use the Application. (If you do not accept the EULA, do not use the Application).
DRAGONSLASH reserves the right to modify at any time the terms of the EULA without notice or right to compensation of any kind.
The EULA is to govern the overall relationship between You and DRAGONSLASH when you use the Application. The EULA is not concluded with the manufacturer of your smartphone or the publisher of the platform where You downloaded the Application. The EULA also specifies the Privacy rules applicable to the Application.
The application includes 5 challenges each with several missions. At the end of each mission, you'll be assessed by a jury of experts who will give you points depending on your speed, precision or technique. To win the tournament, you need to get the maximum points in each of challenge. The goal is to stay at the top of the ranking to win the reward and watch the end of your hero.
It is possible to use some "packs of Second Chance cards" and some "bottles" to help you to improve your score. These "packs of Second Chance cards" and "bottles" can be purchased in the shop of the application.
The app is available on the App Store for $1.99 but may suggest purchase to get and use "jokers". The purchase of "Second Chance cards" (packs of Second Chance cards) and "bottles" (potions) is available within the application, according to a tariff schedule.
The app is free-to-play on Google Play. It is possible to remove the advertisement from the application and increase the number of "Second Chance cards" offered by default by making a payment. The game may also suggest to get and use "jokers". The purchase of "Second Chance cards" (packs of Second Chance cards) and "bottles" is available within the application, according to a tariff schedule.
The purchase of the "Second Chance cards" and "bottles" are subject the terms and conditions of the platforms of distribution "App Store" or "Google Play".
Purchases require an internet connection.
Using the Application does not require the creation of a Facebook, Twitter or Instagram account, but you can share your score on social networks through a function "share" within the application.
DRAGONSLASH is not responsible for the content you share. You are solely responsible for the texts and images you share on social networks, sites, emails, blogs.
The EULA grants you a personal, exclusive, transferable and non-assignable right of use of the Application. The Application may only be used on a compatible device. The information is displayed on the game download page on the App Store and on Google Play.
In accordance with the applicable provisions of the Code of Intellectual Property, only the use of the Application for private use is permitted, the excluding any other use that would constitute infringement acts punished as such. You may not, therefore, in particular, to use all or part of the Application for commercial purposes. You also agree not to redistribute the Application in any manner whatsoever.
Nothing in EULA transfers to your benefit any intellectual property rights whatsoever in relation to the application as a whole or any of its components, whether, without limitation: its design, interface, graphics, text, sound, software and algorithms used works, databases, etc. Any copy of the Application is prohibited. A backup is useless since the application can be downloaded from the download platforms.
The trademarks "REIGN OF THE NINJA®" and "DRAGONSLASH®" have been filed at the National Institute of Industrial Property (INPI) and are the exclusive property of DRAGONSLASH company. You may not use any of these trademarks without the consent of DRAGONSLASH.
DRAGONSLASH does not warrant that the Application will be running continuously or being free from errors. The Application is provided as is without warranty of any kind. DRAGONSLASH will make every effort to correct any errors when they are known.
DRAGONSLASH will not be required to allow access to the application in the event of force majeure heard within the meaning of the French case law, as any event unpredictable, irresistible and external such as strikes, bad weather, wars, embargoes, failure of the electrical network or Internet, satellite failures, failures of the Internet access providers with their obligations.
DRAGONSLASH disclaims all liability for any interruption of the Application, the occurrence of bugs or errors in operation and in the event of damage, direct or indirect, including loss of profit, data corruption, whatever the causes, origin, nature or consequences caused by the access of anyone to the software or the inability to access it.
In particular, DRAGONSLASH assumes no responsibility for any damage that might be caused to your computer equipment (smartphone, tablet, computer, iPod, etc) as a result of accessing the application, use or downloading of any of its elements (data, text, images, videos or sounds, etc.).
The Application does not collect any personal data within the meaning of Law No. 78-17 of 6 January 1978 "Data Protection".
The Application collects however some purely technical information used in the smartphone and tablet (operating system, smartphone/tablet model, language by default, etc). These are used in order to help the right operation of the application and to correct any errors in the Application.
When you visit our website (http://www.reignoftheninja.com), we collect information about you, such as details about how you use and interact with the website. We may use the information we collect about you for a number of purposes, including for optimize the website and for research or analysis.

You agree that you are at least 7 years old and that if you are between 7 years and 18 years old, your parents (or your legal guardian) have reviewed and agree to these End-User License Agreement.
The EULA is governed by French law.
Any dispute relating to the EULA will be subject to the exclusive jurisdiction of the competent court in Paris (France), subject to contrary provisions.

CONDITIONS GENERALES D'UTILISATION
Ces Conditions Générales d'Utilisation ("CGU") sont éditées par la société DRAGONSLASH, société française au capital de 20 000 euros, identifiée sous le numéro 821 658 986 RCS Montpellier, dont le siège social est situé au 73 Boulevard de Strasbourg 34000 Montpellier France (ci-après "DRAGONSLASH"), éditeur de l'application "REIGN OF THE NINJA" (ci-après "Application").
L'utilisation de l'Application est soumise à l'acceptation complète des CGU définissant la relation entre les utilisateurs (ci-après "vous") et DRAGONSLASH. Merci de lire ces CGU avec attention. En l'absence d'une telle acceptation, vous ne pouvez pas utiliser l'Application. (Si vous n'acceptez pas les CGU, n'utilisez pas l'Application).
DRAGONSLASH se réserve le droit de modifier à tout moment les termes des CGU sans préavis ni droit de compensation de quelque nature que ce soit suite à la modification de ces CGU.
Les CGU régissent la relation globale entre vous et DRAGONSLASH lorsque vous utilisez l'application. Les CGU ne sont pas conclue avec le fabricant de votre smartphone ni avec l'éditeur de la plate-forme où vous avez téléchargé l'application. Les CGU spécifient également les règles de confidentialité applicables à l'application.
L'application est composée de 5 épreuves contenant chacune plusieurs missions. À la fin de chaque mission, un jury d'experts octroie des points en fonction de la rapidité, de la précision ou de la technique. Pour remporter le tournoi, il faut obtenir le maximum de points dans les épreuves. Le but est de rester en tête du classement afin de remporter la récompense et accéder à la fin de son héro.
Il est possible d'utiliser des "packs de cartes chance" et des "fioles de recharges" afin d'augmenter ses chances d'améliorer son score. Ces "packs de cartes chance" et ces "fioles de recharges" sont disponibles dans la boutique du jeu, selon un barème tarifaire.
L'achat de ces "packs de cartes chance" et de ces "fioles de recharges" est relatif aux Termes et Conditions des plateformes de distribution "App Store" ou "Google Play".
L'application est disponible sur l'App Store au prix de 2,29 euros mais peut suggérer un achat pour obtenir et utiliser des "packs de cartes chance" et/ou des "fioles de recharges". Les achats de "packs de cartes chance" et/ou de "fioles de recharges" sont effectués dans la "boutique" de l'application, selon un barème tarifaire.
L'application est en "free-to-play" sur Google Play. Il est possible de supprimer la publicité du jeu et d'augmenter le nombre de "cartes chance" offertes par défaut en effectuant un paiement. Le jeu peut également suggérer un achat pour obtenir et utiliser des "packs de cartes chance" et/ou des "fioles de recharges". L'achat de "packs de cartes chance" et/ou de "fioles de recharges" est effectué dans la "boutique" de l'application, selon un barème tarifaire.
Les achats sont soumis aux termes et conditions des plateformes de distribution App Store ou Google Play.
Les achats proposés requièrent une connexion internet.
L'utilisation de l'Application ne nécessite pas la création de compte Facebook, Twitter ou Instagram, mais vous pouvez partager votre progression sur les réseaux sociaux via la fonction "share" de l'application.
DRAGONSLASH n'est pas responsable du contenu que vous partagez. Vous êtes seul responsable des textes et images que vous partagez sur les réseaux sociaux, sites, emails, blogs.
Les CGU vous concèdent un droit d'utilisation personnel, exclusif, transférable et non cessible de l'application. L'application ne peut être utilisée que sur un appareil et un système compatible. Les informations sont affichées sur la page de téléchargement de l'Application située sur l'App Store et sur Google Play.
Conformément aux dispositions applicables du Code de la Propriété Intellectuelle, seule l'utilisation de l'Application pour un usage privé est autorisée, à l'exclusion de toute autre utilisation qui constituerait des actes de contrefaçon sanctionnés en tant que tels. Vous ne pouvez donc pas utiliser tout ou partie de l'Application à des fins commerciales. Vous acceptez également de ne pas redistribuer l'Application de quelque manière que ce soit.
Rien dans les CGU ne transfère à votre avantage des droits de propriété intellectuelle relatifs à l'ensemble de l'Application ou à ses composants, que ce soit sans limitation : conception, interface, graphisme, texte, son, logiciel et algorithmes, œuvres, bases de données, etc. Toute copie de l'Application est interdite. Une sauvegarde est inutile car l'application peut être téléchargée depuis les plateformes de téléchargement.
Les marques "REIGN OF THE NINJA®" et "DRAGONSLASH®" ont été déposées auprès de l'Institut National de la Propriété Industrielle (INPI) et sont la propriété exclusive de la société DRAGONSLASH. Vous ne pouvez utiliser aucune de ces marques sans le consentement de DRAGONSLASH.
DRAGONSLASH ne peut pas garantir que l'application fonctionnera en continu ou sera exempte d'erreurs. L'application est fournie telle quelle sans garantie d'aucune sorte. DRAGONSLASH fera tout son possible pour corriger les erreurs lorsqu'elles seront connues.
DRAGONSLASH ne sera pas tenu de permettre l'accès à l'application en cas de force majeure entendue au sens de la jurisprudence française, comme tout événement imprévisible, incompressible et externe tels que grèves, intempéries, guerres, embargos, panne d'électricité, défaillances de satellites, défaillances des fournisseurs d'accès Internet.
DRAGONSLASH décline toute responsabilité en cas d'interruption de l'Application, de survenance de bugs ou d'erreurs dans l'exploitation et en cas de dommage, direct ou indirect, y compris le manque à gagner, la corruption de données, quelles qu'en soient les causes, origine, nature ou conséquences, l'accès de quiconque au logiciel ou l'impossibilité d'y accéder.
En particulier, DRAGONSLASH ne pourra pas être tenu pour responsable de dommages qui pourraient être causés à votre équipement informatique (smartphone, tablette, ordinateur, iPod, etc) suite à l'accès à l'application, l'utilisation ou le téléchargement de l'un de ses éléments (données, textes, images, vidéos ou sons, etc.).
L'Application ne collecte aucune donnée personnelle au sens de la Loi n ° 78-17 du 6 janvier 1978 "Protection des données".
L'Application recueille cependant certaines informations purement techniques utilisées dans le smartphone et la tablette (système d'exploitation, modèle de smartphone / tablette, la langue utilisée, etc). Ceux-ci sont utilisés afin d'aider au bon fonctionnement de l'application et pour corriger les erreurs dans l'application.
Lorsque vous visitez notre site (http://www.reignoftheninja.com), nous collectons des informations personnelles notamment des détails sur la façon dont vous l'utilisez et vos interactions avec celui-ci. Nous pouvons utiliser les informations personnelles que nous collectons à plusieurs fins, notamment pour l'optimisation du site web et à des fins de recherche ou d'analyse.
Vous jouissez de certains droits par rapport à vos informations personnelles et la façon dont nous les gérons. Vous pouvez exercer ces droits à tout moment en nous contactant par email à partir du site http://www.dragonslash.com
Vous reconnaissez avoir au moins 7 ans. Si vous avez entre 7 ans et 18 ans, vos parents (ou votre tuteur légal) affirment avoir donné leur accord à ces CGU.
Les CGU sont régies par la loi française.
Tout litige relatif à ces CGU sera soumis à la juridiction exclusive du tribunal compétent français, sous réserve de dispositions contraires.
